DISTANCE SALES AGREEMENT

1. PARTIES

BUYER: The user who activates the AISHE System-Client license via the hardware-bound identification (Hardware ID) on the website https://app.aishe.pro.


2. SUBJECT

The subject of this Agreement is to determine the rights and obligations of the parties in accordance with the Law on the Protection of Consumers and the Regulation on Distance Contracts regarding the sale and performance of the AISHE System-Client License. This license is a digital SaaS product that the Buyer has tested for 14 days and subsequently ordered via electronic environment.

3. SERVICE AND PAYMENT DETAILS

  • Service Description: Activation of the AISHE System-Client software for a period of 30 days.

  • Delivery: The license activation is performed instantly in the digital environment via the unique Hardware ID generated by the Buyer’s device upon payment.

  • Payment Model: This is a "Pay-as-you-go" model. There is no automatic recurring subscription. The Buyer manually initiates payment for each 30-day period they wish to use the system.

4. 14-DAY TRIAL AND ACTIVATION LOGIC

  • The Buyer acknowledges and declares that they have been granted a 14-day, full-featured free trial period prior to the purchase and has utilized this period to evaluate the software.

  • The software generates a unique Hardware ID specific to the Buyer's device.

  • By proceeding with the payment, the Buyer confirms that they have tested the software, verified its compatibility with their hardware, and voluntarily decided to trigger the 30-day activation.

5. RIGHT OF WITHDRAWAL (REFUND POLICY)

In accordance with Article 15 of the Regulation on Distance Contracts (Turkey):

  • The Right of Withdrawal cannot be exercised for contracts regarding services performed immediately in the electronic environment or intangible goods delivered immediately to the consumer.

  • The Right of Withdrawal cannot be exercised for goods or services customized to the consumer’s specific needs (in this case, the unique Hardware-ID binding).

  • Conclusion: Since the Buyer has already utilized a 14-day trial and the activation is tied to a specific Hardware ID and performed instantly, no refunds are possible once the payment is processed and the license is activated.

6. GENERAL PROVISIONS

  • The Buyer declares that they are over 18 years of age and has read and understood the fundamental characteristics of the service, the sale price, and the payment terms.

  • The Seller is responsible for the availability of the License and API servers. The Buyer is responsible for their own hardware performance and internet stability.

7. AUTHORIZED COURT

In the implementation of this Agreement, the Consumer Arbitration Committees and the Consumer Courts at the Seller’s place of residence are authorized.
